Fine imposition by BTRC on Grameenphone held illegal by the High Court:A successful representation by Junayed Ahmed Chowdhury, Tanvir Quader along with AM Aminuddin as the senior counsel.

26.08.2019: The High Court Division yesterday in a major verdict held that the fine imposition by Bangladesh Telecommunication Regulatory Commission (BTRC) of BDT 300 million (30 crore) on Grameenphone (GP) in 2016 and 2017 through three letters was illegal.

The case involved substantial analysis and interpretation of sections 63 and 65 of the Bangladesh Telecommunication Regulation Act 2001 (BTRA). The court held that BTRC’s reliance on section 63 of the BTRA to impose the fine was misconceived in law and it did not follow the due process under section 65 before imposing the fine on GP.
