The Appellate Division has delivered a landmark judgment holding that the imposition of conversion charge by RAJUK for providing permission to construct a multi-storied commercial building is illegal.
Our Managing Partner, Senior Advocate Junayed Chowdhury, represented the Petitioners in the original Writ Petition before the High Court Division and successfully won the case (reported in 23 BLC (2018) 428). The judgment of the High Court Division was later overturned by the Appellate Division on appeal. However, the Petitioners filed a Civil Review against the Appellate Division’s judgment. The concise statement of the Civil Review Appeal was drafted by Senior Advocate Junayed Chowdhury upon instruction of the Petitioners. Based on the concise statement and upon hearing the Civil Review Appeal, the Appellate Division overturned its own decision and restored the High Court Division’s judgment. The reasoning of the Appellate Division’s judgment in the Civil Review Appeal is substantially based on the arguments raised in the concise statement drafted by Senior Advocate Junayed Chowdhury.
It is a very rare phenomenon where the Appellate Division overturned its own decision.
